Consultants meeting the above criteria should submit a proposal marked “Country Safeguarding Context Mapping, Lebanon” by e-mail to tenders@trocaire.org at the latest on 30th January, 2023, 5PM GMT.
Proposals should include the following:
• The CV of the consultant(s), outlining relevant experience, accomplishments, and contact
information of 2 references.
• A written technical and financial proposal, outlining the proposed content, schedule/work
plan and the consultant’s proposed fees/daily rate, with justification.
• Conflict of interest statement: Applicants should state clearly whether they have an actual or potential conflict of interest with the staff, volunteers, and/or board of Trócaire.
Each technical proposal will be evaluated based on technical quality; background and experience of the consultant; and value for money.
The successful candidate will be expected to sign and adhere to Trócaire Safeguarding Policies. In addition, the successful candidate will be expected to complete a Self-Declaration Form.
- Background
Trócaire is committed to keeping people safe from exploitation and abuse within our programmes and activities. We also give a commitment to respond appropriately should an allegation of abuse be raised. This includes complaints management, investigations and disciplinary processes as well as recognising our responsibility under the relevant legislation in Lebanon.
In order to ensure our safeguarding procedures are in line with both best practice and in-country legislation it is important to have a clear understanding of this in advance of any possible allegation. Not knowing this in advance could delay our capacity to respond (as we seek to find out this information) and/or not respond appropriately. Equally we want to ensure that the best supports are available for anyone who may be involved as this is central to a robust person-centred response.
The Country Safeguarding Context Mapping is therefore an important document / set of documents which will help guide both the continued development of our safeguarding practices as well as ensuring we are well informed in order to take immediate appropriate action should an incident occur.
- Objectives of the study
2.1 Overall Objective
The objective of this study is to provide a report with Lebanon specific safeguarding information that would support the roll-out of the Trócaire and partners’ response/management of potential safeguarding concerns.
2.2 Specific Objectives
Report on the following:
- Summary and analysis of legal issues on welfare/safeguarding/protection of children including the ratified international conventions and what is in practice reflection the law 422.
- Summary of legislation in relation to sexual abuse, harassment and assault.
- Summary and analysis of Criminal Investigation/Prosecution – Police and Judiciary against children and adult.
- Summary and analysis of what other agencies (Health Services, INGOs, NGOs, Inter-agency Forums) that provide victim support in Lebanon do in this area.
- Summary and analysis of Community based systems (formal and informal) that provide victim support in Lebanon. Including the PSEA network and the referral mechanism.
- Summary and analysis of Employment and Legislation considerations for safeguarding of children and sexual harassment in the workplace including specifics around suspension and termination of contract.
- Do a summary version of the report using the Trócaire Safeguarding context mapping template for safeguarding.
- Methodology
3.1 Desktop Review
This work is considered to be a desk review. It is appreciated that some consultation with relevant services may be required but this should be via remote means (phone, zoom etc).
Desk-based review of key Trócaire and external documentation including but not limited to
- Trócaire policies on safeguarding
- Analysis of legislation including child protection, sexual assault, physical assault, bullying and harassment (including within the workplace)
- Analysis of case examples that demonstrate how the legal framework is applied
- Analysis of support services for survivors of adult and child protection abuses, sexual assault, physical assault, bullying and harassment and how to refer people to these services
- Identify any other services as relevant in-country that are not included within the Context Mapping document
- Best practices and innovative approaches in safeguarding practices in Lebanon.
3.2 Consultation
- The consultant will collect information from key staff in Trócaire HQ and Lebanon Field office and potentially partners in specific regions, Government officials – national and sub-regional, and key stakeholders such as UNICEF.
3.3 Analysis and Reporting
The consultant should analyse and present the findings of the mapping to Trócaire Lebanon. The analysis phase needs to include a clear analysis of the legislative frameworks, so they are presented in accessible language in summarised manner; that services are analysed, and the most appropriate/best practices options are presented.
If Trócaire Lebanon considers the draft report to be of sufficient quality, they will circulate for comments from key stakeholders. The draft report will be incorporate the comments from Trócaire and key stakeholders to develop a final report.
- Deliverable
4.1 Inception Report
The consultant will prepare a short inception report (not more than 5 pages) to be submitted within 4 days of the start of the consultancy. The report will describe the findings of the document review, a suggested list of key persons that will be consulted/interviewed in the consultation stage and any key findings s/he may have already made. The inception report is also an opportunity for the consultant to discuss any concerns and/or challenges that s/he may be having and engage with Trócaire to resolve these.
4.2 Reports
- A draft report in English based on the required format. This will be reviewed by the Trócaire Lebanon office and if it is deemed of sufficient quality it will be shared with HQ and a broader group of stakeholders for comments.
- A final report in English based on the required format which has incorporated the feedback provided by Trócaire and our stakeholders.
- Timeframe
It is expected that this work will be completed within three weeks (15 working days) from date of contract. Proposals should indicate the number of days work involved.
- Supervision and oversight
The consultant will be coordinating with Trócaire Protection and Accountability Manager based in Lebanon. Additional support will also be provided by the Trócaire’s Head of Safeguarding in HQ and the Country Director as required.
- Profile and Qualification of the Consultant
The consultant will have the following competencies and skills:
- Preferably lawyer that has understanding/experience of safeguarding as it pertains to the INGO sector.
- At least 5 years of relevant experience in Lebanon.
- Practical Knowledge of the laws in Lebanon as they pertain to this consultancy.
- Good track record to deliver high quality outputs within agreed timeframe.
- Good communication skills.
- Excellent language skills in English and Arabic, both written and spoken.
